U.S. District Judge Mark Wolf ruled in the landmark case of Robert Kosilek, who was born a man but has received hormone treatments and now lives as a woman in an all-male prison. Kosilek was convicted of murder in the killing of his wife in 1990.

Kosilek, who now uses the name "Michelle", has been fighting the state of Massachusetts over gender reassignment for more than ten years.  Prison officials say it’s a security issue, because allowing the surgery would make her a target for sexual assaults by other inmates.

The judge says those concerns can be met and dealt with, and prison officials have a duty to decide how and where to house Kosilek after "she" has the surgery.
